Audience Target provides business-to-business (B2B) software and services including:
- Programmatic Job Distribution: Automated job advertisement placement across social media, career sites, and partner networks
- AI Communication Platform: Intelligent messaging, chat, text, email, and phone capabilities
- Website Integration: Chat and text functionality for lead generation and customer engagement
- Data Processing & Analytics: Lead generation, performance tracking, and business intelligence
- Software as a Service (SaaS): Cloud-based platform access and fully managed service options
3. User Accounts and Registration
3.1 Account Types
We offer different account profiles including SaaS subscription accounts, fully managed service accounts, and individual user profiles within client accounts.
3.2 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Billing and Payment
4.1 Payment Methods
We offer multiple billing options including manual invoicing for enterprise and fully managed services, and automated SaaS billing for subscription services. Manual invoicing is set to an agreed upon schedule and does not auto renew.
4.2 Payment Terms
SaaS subscription fees are billed in advance on a recurring basis. Invoice payments are due within thirty (30) days of invoice date. All SaaS fees are non-refundable unless otherwise specified. Fully managed campaigns are paid in advance of media running and are non-refundable.
4.3 Late Payments
Late payments may result in service suspension and additional fees as permitted by law.
5. User Responsibilities and Conduct
5.1 Acceptable Use
You agree to comply with all applicable laws and regulations, maintain appropriate conduct on our platforms, use our services only for legitimate business purposes, and respect the intellectual property rights of others.
5.2 Prohibited Uses
You may not use our services for any unlawful or fraudulent purpose, transmit harmful or offensive content, attempt to gain unauthorized access to our systems, interfere with or disrupt our services, or violate any applicable employment or recruiting laws.
6. Third-Party Integrations
Our services integrate with various third-party platforms including applicant tracking systems, SaaS platforms, payment gateways, career sites and job boards, social media platforms, and company websites. You acknowledge that these integrations are subject to the terms and policies of the respective third-party providers.
7. Data and Privacy
7.1 Data Processing
We process data in accordance with applicable regulations including but not limited to GDPR, CCPA, and other relevant privacy laws.
7.2 Data Security
We implement reasonable security measures to protect your data, though no system is completely secure.

8. Intellectual Property

You retain ownership of content you submit to our platform but grant us a license to use such content as necessary to provide our services.
9. Service Availability
9.1 Uptime
We strive to maintain industry-standard uptime for SaaS platforms (typically 99.9% availability), though we do not guarantee uninterrupted service.
9.2 Maintenance
We may perform scheduled maintenance that temporarily affects service availability. We will provide reasonable notice when possible.
10. Termination
10.1 Termination by User
You may terminate your account at any time by following our account closure procedures or contacting our support team.
10.2 Termination by Us
We may terminate or suspend your account immediately if you breach these Terms or engage in prohibited conduct.
10.3 Effect of Termination
Upon termination, your right to use our services ceases immediately. We may delete your data in accordance with our retention policies.
11. Limitation of Liability

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
11.2 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL MARKETING GEN, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
11.3 Maximum Liability
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Digital Marketing Gen, Inc. from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes arising under these Terms shall be resolved through binding arbitration in New York State, except that either party may seek injunctive relief in court.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of our services after changes constitutes acceptance of the new Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Digital Marketing Gen, Inc. regarding the use of our services.
19. SMS Communications Terms
19.1 Business Identity & SMS Use Cases
Audience Target (Digital Marketing Gen, Inc.) uses SMS messaging to communicate with opted-in contacts. Messages may include driver application status updates, document reminders, interview scheduling, recruiting follow up, and job opportunity notifications.
19.2 Opt-Out & Support Mechanisms
You can cancel the SMS service at any time. Just text "STOP" to +1 (516) 604-7332. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

19.3 Message and Data Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages as needed throughout your recruiting or application process. Message frequency varies based on your activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
19.4 Carrier Liability
Carriers are not liable for delayed or undelivered messages.
19.5 Age Restriction
SMS communications are intended for individuals 18 years of age or older.
19.6 Privacy Policy

19.7 SMS Non-Sharing
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
